CHD Sues HHS Secretary RFK Jr. Over Failure to Enforce Childhood Vaccine Safety Mandate

Lawsuit alleges breach of 1986 U.S. vaccine law

A lawsuit filed by U.S. attorney Ray Flores and funded by Children’s Health Defense (CHD) accuses U.S. Health Secretary Robert F. Kennedy Jr. of failing to implement a key safety provision in the National Childhood Vaccine Injury Act of 1986.

The lawsuit alleges that Kennedy, who now leads the U.S. Department of Health and Human Services (HHS), is legally obligated to form a task force to improve vaccine safety and report biennially to Congress—duties that have been ignored by every HHS secretary since the law was passed.

“It is blackletter law that the HHS Secretary must convene a task force on how to make vaccines safer,” said Mary Holland, Esq., President and General Counsel of CHD. “That no secretary has done so since the passage of this law is a blow to the rule of law. I hope and trust that the current secretary will fulfill his obligation to Congress’ mandate.”

Flores is seeking a court order to compel Kennedy to establish the task force and begin issuing the overdue safety reports. The case draws attention to long-standing gaps in vaccine oversight and transparency in the U.S.
